Fortress Technologies Inc. (“Fortress,” “we,” “us,” or “our”), a Delaware corporation, operates fortress-tech.com (the “Site”) to provide authorized information on our force-protection systems: LUMEN, BOLT cUAS, and SPEAR.

By accessing or using the Site, submitting lead forms, registering for calendar events, or otherwise interacting with the Site, you agree to these Website Terms of Use (“Terms”). If you do not agree, cease all use immediately.

These Terms are separate from our Privacy Policy, which governs data handling and is incorporated by reference for all information submissions.

1. Acceptance and Modifications

Your use constitutes affirmative acceptance of these Terms and the Privacy Policy. Fortress may update these Terms; continued use after changes (new Effective Date) constitutes acceptance.

2. Permitted Use and Restrictions

The Site is provided solely for legitimate informational and business-development purposes related to Fortress capabilities for U.S. military, government, and authorized partners.

You agree not to:

Use the Site for any unlawful purpose or in violation of U.S. export control laws (ITAR/EAR).

Transmit harmful code, scrape content, data-mine, or engage in unauthorized bulk solicitation.

Impersonate any person or entity.

Attempt to access or solicit any ITAR-controlled technical data through public channels (none is available on the Site).

3. Lead Forms and Event Registrations

When submitting forms or registering for events, you represent and warrant that:

All information is true, accurate, and current.

You have full authority to submit on behalf of yourself and any represented organization.

You consent to Fortress contacting you via provided channels for legitimate follow-up.

You are a U.S. person (as defined under ITAR) or acting in a capacity authorized under applicable export controls for the requested interaction.

All submissions are governed by the Privacy Policy. Deeper technical engagements will require separate vetting and compliance with ITAR/EAR.

4. Intellectual Property

All Site content, including text, graphics, logos, product names (LUMEN, BOLT, SPEAR), capability materials, and code, is the exclusive property of Fortress Technologies Inc. or its licensors and protected by U.S. and international intellectual property laws. No license is granted except the limited right to view publicly available information for internal evaluation of Fortress capabilities. Unauthorized reproduction, distribution, or use is prohibited.

5. No Warranties; Limitation of Liability

The Site and content are provided “as is” without warranties of any kind. Fortress disclaims all express or implied warranties, including merchantability, fitness for purpose, and non-infringement.

In no event shall Fortress, its directors, officers, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising from Site use, even if advised of the possibility. Total liability shall not exceed $100.

6. Indemnification

You agree to indemnify, defend, and hold harmless Fortress and its affiliates from any claims, losses, liabilities, or damages arising from your violation of these Terms, misuse of the Site, or breach of representations regarding authority or export compliance.

7. Export Control Compliance

Fortress maintains a robust export compliance program in accordance with ITAR and EAR. The public Site contains only non-controlled, publicly releasable information. Any request for technical data, defense services, or controlled information will be processed through authorized, secure channels with appropriate screening, licensing (if required), and record-keeping. Unauthorized access attempts or requests violating export controls are strictly prohibited and may be reported.

8. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the state or federal courts located in Delaware. You consent to personal jurisdiction and venue in such courts.

9. Miscellaneous

Severability: If any provision is held invalid, the remainder remains in effect.

No Waiver: Failure to enforce any right does not constitute a waiver.

Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement regarding Site use.
